TO: hostmaster@lunarpages.com domains@lunarpages.com support@add2net.com abuse@add2net.com

To whom it may concern:

The site of http://cavetcom.com, that you are affiliated with either directly or indirectly, is a FRAUD.

I present you with the following as proof:
1. This site is exactly like a previous fraud site of http://auto-bt.net which is already shutdown (Please see the cached layout for comparison at http://64.233.161.104/search?q=cache:2C ... /index.php ) AND a previous fraud site of http://escrovvcom.com (see http://64.233.161.104/search?q=cache:3y ... /terms.php to compare with http://cavetcom.com/terms.php ).

2. All 3 of these sites are listed in a fraud database at http://escrow-fraud.com/fraud_data.php?id=1347 , http://escrow-fraud.com/fraud_data.php?id=1349 , http://escrow-fraud.com/fraud_data.php?id=1351 (along with MANY others.)

3. This fraudulent layout has been used numerous times. See http://escrow-fraud.com/images/sites/ and more specifically http://escrow-fraud.com/images/sites/Layout35/ . Each image was taken from a sepearate web-site. From there you will see that this site layout has been used by fraudulent sites NO LESS than 11 times and more when you consider the variations of the theme.

4. You will also see that the TERMS page, http://cavetcom.com/terms.php , is stolen (almost verbatim) from https://auctionchex.com/index.php?ap=home&at=aterms (a legitimate company)

These are just a few points to consider but I believe it's adequate enough to prove that indeed cavetcom.com is a fraud

Please stop helping others to perpetrate a fraud, and do whatever is in your power to remove cavetcom.com and report the offenders to the proper authorities.

Thank You.

Please consider Copying and Pasting this message into an email and send it from your email account. The more a web host gets, the more likely they are to take action.

Feel free to "Personalize" it as well.

i haven't yet found where add2net is incorporated. looking for registered agent.

still looking. they need a drastic change in policy. putting their own name on a criminal website seems foolish to me.

In order for Lunarpages to act upon the allegedly infringing material we require the following information:

5. A proper statement that the complaining party has a good faith belief that this site is in deed committing fraud by a registered authority or the law.

7. a statement under penalty of perjury that the complaining party is authorized to act on on this issue.

In particular items that would be helpful to us would include proof of any federally filed complaints.

Once we receive a notice which is in compliance with the above notice provisions we can consider taking further action which might include but would not be limited to notification to our customer, warning our customer or disabling of the web site as Lunarpages determines might be reasonable and necessary under the circumstances.

My Response to above

Postby peg » Mon Jul 17, 2006 5:14 pm

Here was my response:

In regard to your response I submit the following for clarification:

1. Identification of the work alleged to be fraudulent.
This was provided in the original complaint.

2. Identification of the allegedly infringing material sufficiently precise to allow Lunarpages to locate the material.
The entire site is a fraud... Not just a particular portion. However, I have provided a limited portion (in the original complaint) in regards to stolen information (in regards to the "TERMS" page of the offending site)

3. Adequate information by which we can contact the complaining party specifically including a physical postal address, telephone number and email address.
You have adequate information to contact me (one of the complaining parties) as I have received your response. I tend to keep the remainder of my information confidential due to the nature of these fraudulent sites. The fact that they are often run by organized crime puts me at risk. Should it be necessary to contact me directly, I could call you on the number provided to give more details.

5. A proper statement that the complaining party has a good faith belief that this site is in deed committing fraud by a registered authority or the law.
Again, I have provided my statement that I do believe that this site
(http://cavetcom.com/) IS committing a fraud. YOU are the "Registered authority" that I chose to file a complaint with. I cannot file a complaint with local law enforcement as I have not been defrauded (directly) by http://cavetcom.com/ , nor will I. This is not to say that others have not or will not. Look at the facts as I presented them to you in the original complaint. Moreover, these sites usually pay with a stolen credit card.
Perhaps you could/should verify that more completely now, prior to you loosing one to several months fees when the person finally notices the unauthorized charges.

6. a statement under penalty of perjury that the information in the notice is true and correct.
and I swear under penalty of perjury on the bible and to god, on my grandmothers (both of them) and grandfathers (both of them) graves, cross my heart hope to die........ that the information I have provided you I believe to be 100 percent true and accurate.

7. a statement under penalty of perjury that the complaining party is authorized to act on this issue.
HUH????? It's a fraud... What authorization do I need to point out a fraud.
I am trying to help YOU and I am trying to help others who might fall for this trap..... Fraud is Fraud. Who needs "AUTHORIZATION" to report a fraud.
It's not like the owner of the site http://cavetcom.com/ is going to call you up and say.."Yes John Q. Public is Authorized to report our site as fraud"... Get real See this site for what it is. A fraud.

If I sound Passionate about the subject, it's because I am. I was frauded once, and that's enough for me. Help me help others and stop helping criminals to perpetuate a fraud and CLOSE http://cavetcom.com/ NOW!

Thank you for your time.

this is completely insane. it is in reverse. upside down. when people complain that a financial site is a fraud, the host needs to provide evidence that it is legit or take it down. really, the local police in california sould go pull the plug out of the wall.

i have a new form for hosts:

You are the owner, operator of a FRAUD fake website located at xxx.com. of course the information about the registrant is false as criminals are dishonest but not stupid. this make your company the only party responsible for any losses. information that your company is responsible for fraud against the public will be posted at escrow-fraud.com, aa419.org, scam.com, ripoffreport.com, ebay escrow forums and any other public forum on the subject of escrow fraud. if you have any evidence that the website is legitimate or your company is not responsible, you may respond to this email and i will be at your service to correct these public postings.

consider this: riaa formed to sue websites that were giving away copyrighted material. and they have had much sucess. we need an association too. i dun know what to call it, but i think we can claim that webhosts have damaged our our business online at ebay, craigslist, others.

another idea i have is to get attention of aarp. if we could propose an anti-fraud law with aarp backing, who could vote against it ?

just $1000 fine for each webpage registration found to be false would end the problem in a day.

Here is another interesting twist to this story.... Let's see what response it gets. When I sent the last resposne to Lunarpages.com, I copied auctionchex.com (as their material was stolen.) The Founder and CEO of Auctionchex responded with the following

Founder & Ceo of Auctionchex.com wrote:To whom it may concern :

A statement under penalty of perjury that the information in the notice is true and correct.

In my capacity as website owner of auctionchex.com I am reporting to you that :

http://cavetcom.com IS a fraudulent escrow service website

http://cavetcom.com/terms.php is a copy of our terms page found at:

https://auctionchex.com/index.php?ap=home&at=aterms

I hereby formally request you to suspend service to http://cavetcom.com forthwith to avoid any legal implications that you as the notified webhost may be liable to.

Thank you

Regards from Eddie StClare

Founder & CEO of: auctionchex.com and auctionpix.co.uk

Auctionpix.co.uk: For FREE eBay image hosting, templates, supersize slideshows, auction scheduling and more....

Auctionchex.com : For USD/Euro payments, Exchange, Hyperwallet, Escrow service and more....

Auctionchex.com is authorised and regulated by Her Majesty's Revenue and Customs in the United Kingdom as a:
Bureau de Change, Money Transmitter and Cheque Casher - Money Services Business License Number #12145060 Auctionchex.com Compliance Officer : Mr E W StClare Auctionchex.com is also PayPal Compliant as a Financial Services Provider.
Auctionpix.co.uk is an established eBay Developers Program Member.

As of yet nothing has been done, but there needs to be a resource to have these sites shutdown quicker. I know Lunarpages has an automated system and like many others.... and they generally take at least a day (or more) to even acknowldge you.
