What would be your basis of a law suit? Not that I am discoraging it, however, I can't help to wonder how you can hold the ISP responsible for conducting what, they feel, is a legit transaction. In fact, I would guess that, more likely than not, they too lose money in the process (as most are probably paid for with stolen credit cards and ultimately, the merchant would bear that cost.)

The only possible chance you would have when suing XO is proving that (1) the site(s) in question had an abuse complaint filed against them, and (2) you (or the other parties in the suit) were defrauded after the date of the complaint(s). In other words -- if XO's abuse department was negligent or delinquent and didn't take a criminal site offline, that's the only hope you have of even starting a lawsuit.
They host thousands of sites and do not thoroughly review each one for legality before providing services.

Oh hell yes, I totally agree with you guys. I think we can win the case against XO. I tell my lawyer friend about XO's abuse, and he even said XO is probably negligent. But we need info. about how XO neglect complaints and how victims are hurt because of this and things like that. I think XO will try to settle without a doubt if many victims come forward and tell their side of the story.
Anyone who is willing to help in the lawsuit against XO is doing the community a big favor. One reason why there are so many escow fraud site and most of them are on XO servers is because their failure to act.
I have a gut feeling that it is going to be a major case that will define internet law. It will be in the history book and will be remember for years to come

I spoke with a lawyer, and he will open a casefile in May in related to the lawsuit against XO. Thanks for everyone's support, and I think I need as much help as I can get. Please give me as much info. regarding XO's failure to response to complaints and in turn resulted in additional victims. I think this non-sense is ongoing for a few years since the scammers start using XO. Also please anyone who have been defrauded by an escow site using XO as server please step forward. Don't worry about legal fee, it will be on contingency fee, and you don't have to pay for anything. But if you don't step forward I can't help you.
