Based on your observartions, the fact that the creation date for this domain (from the WHOIS info http://pgardner.net/whois.php?ip=Smartest-Thirdpart.com ) was created just over a week ago (at time of post) and the similarities to another known (now shut down) fraud site ( http://escrow-fraud.pgardner.net/images/sites/Layout24/ ) I would definitely advise to NOT trust this site.

Additionally, if you could provide more details about the suspected scammer it can prove helpful to getting them shut down and perhaps even caught. Please see http://forum.pgardner.net/viewtopic.php?t=134 for more specifcs. I can't stress how helpful this can be in trying to stop these scammers.
